Our client received a 90 day driving prohibition after receiving a “fail” reading on a roadside breath testing device. We successfully argued that the result of the roadside tests were not reliable because of recent alcohol consumption. The driving prohibition, monetary penalty and vehicle impoundment were all revoked.
